Insoweit werden auch die Zuständigkeiten zwischen gesetzlicher und privater Krankenversicherung unter besonderer Berücksichtigung des europäischen Gemeinschaftsrechts abgegrenzt. Die Überlegungen münden in eine ordnungspolitische und ökonomische Perspektive für eine neue Wettbewerbsordnung in der Krankenversicherung.

Die Meinung, Urteile nur durch ihre Rückbindung an vom demokratisch gewählten Gesetzgeber erlassene Normen legitimieren zu können, ist in der Rechtstheorie weit verbreitet. Sie mag Grund dafür sein, dass dezisionistische Elemente in der richterlichen Entscheidung als notwendiges Übel angesehen werden, welches so gering wie möglich gehalten werden muss. Die meisten Ansätze in der Rechtstheorie sind deshalb darum bemüht, dezisionistische Elemente zu beseitigen.Anusheh Rafi stellt in seiner Promotionsarbeit mit dem "gebundenen Dezisionismus" einen neuen Ansatz für die Rechtstheorie dar. Nachdem aufgezeigt wird, dass dezisionistische Elemente nicht zu vermeiden sind (1. Kapitel), werden dem Richter Kriterien an die Hand gegeben, mit denen er seine Dezisionsmacht verantwortungsbewusst ausüben kann. Anhand des Zweckes, den der Richter mit der Entscheidung zu verfolgen hat, wenn er ein gutes - d. h. zweckgerichtetes - Urteil fällen möchte (2. Kapitel), werden neun Kriterien aufgestellt, die er bei seiner Entscheidung zu beachten hat (3. Kapitel). Diese Kriterien stellen Topoi der juristischen Argumentation dar, die gegeneinander so abzuwägen sind, dass sie dem Rechtsfrieden - dem Zweck des Urteils - am wahrscheinlichsten dienen.

Landscape architecture and design research is becoming increasingly popular due to rapid urbanization and its impacts on the urban and periurban environment. The constant mitigation and sprawl of urban areas is an imperative and key point for knowing which natural and man-made landscape innovations or patterns are the most suitable and sustainable for urban architecture and design. Such knowledge is crucial to achieving sustainable urbanization while maintaining and improving urban and periurban areas as well as providing a healthy environment for urban residents. Thus, innovative research that is supported by computational approaches, field studies, and spatial analysis to expand knowledge on sustainable urbanization is in high demand. In this Special Issue, we recruited researchers to share their state-of-the-art work on landscape architecture and design combined with sustainable solutions and other research fields such as urban blocks, urban public places, and architectural and design amenities related to urban and periurban environmental engineering for better coping with the urbanization phenomenon. Manuscripts within this Special Issue address sustainable urban design and landscape architecture; the design and management of green spaces; the planning and maintenance of periurban areas; and the expansion of urban areas and their impact on the urban-rural context.
