Environment and Trade : A Guide to WTO Jurisprudence By Nathalie Bernasconi-Osterwalder; Daniel Magraw; Maria Julia Oliva; Elisabeth Tuerk; Marcos Orellana; Philippe Roch
2005 | 391 Pages | ISBN: 1844072983 | EPUB | 1 MB
International trade rules have significant impacts on environmental law and policy, at the domestic, regional and global levels. At the World Trade Organization (WTO), dispute settlement tribunals are increasingly called to decide on environment- and health-related questions. Can governments treat products differently based on environmental considerations? Can they block the import of highly carcinogenic asbestos-containing products or genetically modified crops? Does the WTO allow governments to protect dolphins or endangered sea turtles through the use of import restrictions on certain products? How can civil society participate in WTO dispute settlement? This Guide, authored by five world leaders on international environmental and trade law at the Center for International Environmental Law (CIEL), is an accessible, comprehensive, one-of-a-kind compendium of environment and trade jurisprudence under the WTO. Providing an overview for both experts and non-experts of the major themes relevant to environment and trade, it also analyses how WTO tribunals have approached these themes in concrete disputes and provides selected excerpts of the most significant cases.

Environmental Ethics and Policy-Making By Mikael Stenmark
2016 | 168 Pages | ISBN: 0754605639 | EPUB | 1 MB
Environmental issues raise crucial questions. What should we value? What is our place in nature? What kind of life should we live? How should we interact with other living things? Environmental management and policy-making is ultimately based on answers to these and similar questions, but do we need a new ethics to be able overcome the environmental crisis we face? This book addresses these important questions and explores the values that decision-makers often presuppose in their environmental policy-making. Examining the content of the ethics of sustainable development that the UN and the world's governments want us to embrace, this book examines alternatives to this kind of ethics, and the differences in basic values that these make in practice. Offering a detailed analysis of the ethics that lie behind current policy-making as it is expressed in documents such as Agenda 21 and the Rio Declaration, this unique contribution to the field of environmental studies shows how different environmental ethical theories support different goals of environmental management and generate different policies when it comes to population growth, agriculture, and preservation and management of wilderness areas and endangered species. Mikael Stenmark concludes that policy-makers must take more seriously the value assumptions and conflicts connected to environmental issues, and state explicitly on what values their own proposals and decisions are based and why these should be accepted. Those studying environmental issues or environmental philosophy will find this accessible text invaluable in presenting a clear understanding of environmental ethics and contemporary applications and policies.

Episodes in Early Modern and Modern Christian-Jewish Relations : Diasporas, Dogmas, Differences By Paolo L. Bernardini
2016 | 226 Pages | ISBN: 144389950X | PDF | 1 MB
The history of the Christian-Jewish relations is full of curious, intense, and occasionally tragic episodes. In the dialectical development of the Western monotheistic religions, Judaism plays the role of the "thesis", of the origins and background for the rise of Christianity and Islam. With the rise of Christianity, Judaism was progressively marginalized, since it was denied the same essence and validity of Christianity, which grew immensely in terms of spiritual and secular power. Christian scholars since the Middle Ages looked at Judaism as at the "broken staff" in the evolutionist line of religion, to quote the insightful work of the late Frank E. Manuel. At the same time, while re-discovering Judaism, Christian scholars redefined themselves, and Christianity as well. However, while Christianity encompassed many sects and many nations, the relatively weak diversity within Judaism, the religion of a single nation, seemed to hinder its evolution and development. While the intellectual battle was fought in a scholarly way, the emergence of the Christian State condemned the Jews to perpetual discrimination and occasional toleration, until a lay State, Nazi Germany, threatened the survival of the Jewish people. Neutral controversial works became powerful extermination tools when used in the political arena. This volume casts light on some crucial episodes in the long dialectics within the same intellectual and religious framework, touching upon themes such as the conception of time future in the age of Spinoza, the early encounters of Judaism and Christianity in eighteenth-century England, the memory of the Shoah, and the political revolution present in the system of the Jewish Commonwealth. From early to late Modernity, there is a history of friendship and diffidence, mutual understanding and dramatic disagreements, which, even today, largely conditions the Western intellectual world.

Essays on Aesthetic Genesis By Charlene Elsby; Aaron Massecar
2016 | 249 Pages | ISBN: 0761867694 | EPUB | 1 MB
Essays on Aesthetic Genesis is a collection of essays written on Jeff Mitscherling's work in realist phenomenology, Aesthetic Genesis: The Origin of Consciousness in the Intentional Being of Nature. The authors explicate, expand, contextualize and apply the concepts of intentional being, the "New Copernican Hypothesis" (a reversal of the fundamental tenet of phenomenology that all consciousness is intentional--intentionality, rather, gives rise to consciousness), the idea of intentional structures in nature, and the foundational concepts of Aesthetic Genesis as they appear in the work of Aristotle, Ingarden and Gadamer amongst others. This book takes as its focus Mitscherling's comprehensive phenomenological analysis of embodiment, aesthetic experience, the interpretation of texts, moral behavior, and cognition, and exemplifies subsequent work in the field of realist phenomenology being conducted by an international collection of active scholars influenced by Aesthetic Genesis.

Ethical Socialism and the Trade Unions : Allan Flanders and British Industrial Relations Reform By John Kelly
2010 | 259 Pages | ISBN: 0415878489 | EPUB | 1 MB
Allan Flanders was one of the leading British industrial relations academics and his ideas exerted a major influence on government labor policy in the 1960s and 1970s. But as well as being an Oxford academic with a strong interest in theory and labor reform, he was also a lifelong political activist. Originally trained in German revolutionary ethical socialism in the early 1930s, he was the founder and joint editor of Socialist Commentary, the leading outlet for 'revisionist' social democratic thinking in Britain in the 1950s and 1960s. He was also the leading figure in the influential 1950s 'think tank' Socialist Union and played a key part in the bitter factional struggles inside the Labour Party. The main argument of the book is that Flanders' ethical socialist ideas constituted both his strength and his weakness. Their rigor, clarity and sweep enabled him to exert a major influence over government attempts to negotiate labor reforms with the trade unions. Yet he proved unable to explain the failure of the reforms amidst rising levels of industrial conflict, as his intellectual rigor turned into ideological rigidity. The failure of negotiated reform led to Margaret Thatcher's neo-liberal assault on trade union power in the 1980s.

Ethics in Business Decisions and Competitive Advantage by John E. Triantis
English | December 30, 2024 | ISBN: 1032715030 | 350 pages | MOBI | 17 Mb
Business ethics is the set of practices and policies that companies use to guide them through decisions about finances, negotiations and deals, corporate social responsibility, and more. Without a strong set of ethics, a business can run afoul of the law and encounter financial pitfalls and moral dilemmas.

The objective of this book is a practical, fair, balanced, and objective treatment of the role of ethics in the business performance of companies in competitive markets that demonstrates how ethics affects business culture, strategy, decision-making, and value creation, which then determine competitiveness and business viability. The universality of corruption and the prevalence of unethical conduct is the background from which the narrative describes how ethical issues enter all functional areas.
The ethics' effects on the complexity of decisions and challenges are examined and the questions of why bother with ethical business and whether businesses invite government regulation are answered. Next, a framework is developed to identify and trace links and influences of business ethics on strategic decisions, corporate culture, and decision-making. The effects of strategy and culture on key business success factors and their interdependence are reviewed along with those with competitive advantage elements. These assessments then form the basis of characterizing competitive advantage in the framework developed. Decision-making and strategy links with competitive advantage elements and the inter-competitive advantage element interactions are evaluated along with competitive advantage organizational effects.
The uniqueness of this book is the creation of a method to identify and assess how ethics impacts business decisions and competitive advantage based on accepted economic tenants. It lays the plan for quantitative assessments of the impact of ethical behavior, and it is written from the perspective of a business economist. Other books deal with business ethics elements only; none explains how ethics' effects permeate business sustainability. The main contribution of this book is demonstrating that ethics is a necessary factor for business sustainability. It provides insights to regulators at all government levels, counterbalances ethicist claims about business ethics, and points out how ethical business conduct affects the economy.
