Wie passen das in Art. 6 GG garantierte Erziehungsrecht der Eltern und jugendstrafrechtliche Sanktionen zusammen? Dieser bisher kaum thematisierten Problematik geht Christian Reuther am Beispiel von Jugendarrest und Jugendstrafe nach. Er untersucht detailliert, wie Verhängung und Vollzug dieser Sanktionen das Grundrecht der Eltern beschränken und welche Rechtfertigungsmöglichkeiten es hierfür gibt. Dabei stellt der Autor fest, dass weder im staatlichen Wächteramt aus Art. 6 Abs. 2 S. 3 GG noch in der staatlichen Trennungsbefugnis gemäß Art. 6 Abs. 3 GG eine verfassungsrechtliche Rechtfertigung erblickt werden können. Der Verfasser kommt so zu dem Ergebnis, dass nicht der im Jugendstrafrecht vermeintlich vorherrschende Erziehungsgedanke den Anordnungszweck von Jugendstrafe und Jugendarrest darstellt, sondern die Strafe selbst.Hiervon ausgehend untersucht Christian Reuther die rechtshistorische Herkunft der staatlichen Strafgewalt, um sie sodann verfassungsrechtlich zu verankern. Neben den rechtlichen Ausführungen werden dabei auch Ursachen von Jugendkriminalität und Auswirkungen einer Inhaftierung eingehend behandelt.Im Ergebnis sind staatliche Strafgewalt und die Rechte der Eltern bzw. Erziehungsberechtigten im Wege der praktischen Konkordanz in einen gerechten Ausgleich zu bringen. Vor diesem Hintergrund untersucht der Autor, wie dies der neueren Gesetzgebung zum Jugendstrafrecht gelungen ist. Insbesondere bezüglich der seit dem 1. Januar 2008 geltenden Jugendstrafvollzugsgesetzen der Länder werden entsprechende Defizite aufgezeigt.

Die überschüssigen Emissionszertifikate lassen sich gewinnbringend veräußern.Im Mittelpunkt der Dissertation von Jens Nawrath steht die Untersuchung der Vereinbarkeit zweier Abgaben mit dem Grundgesetz, die im Zusammenhang mit der Ausgabe bzw. der Rückgabe von Emissionszertifikaten von Bedeutung sind. Zum einen wird die Frage erörtert, ob und in welcher Form die staatliche Erhebung eines Zertifikatsentgelts verfassungskonform ist. Zum anderen untersucht der Autor die Verfassungsmäßigkeit der Abgabe nach § 18 Abs. 1 S. 1 TEHG, der eine Zahlungspflicht desjenigen normiert, der seiner Verpflichtung nicht nachkommt, ausreichend viele Emissionszertifikate zum Fälligkeitszeitpunkt an die öffentliche Hand abzugeben.Beide Fragen erfordern schließlich eine vertiefte Auseinandersetzung mit der Sonderabgabendogmatik. Der Verfasser erörtert die Voraussetzungen, unter denen das Zertifikatsentgelt als Sonderabgabe im engeren Sinne verfassungskonform zu normieren ist. Er sieht es als unerlässlich an, das Aufkommen, das der Staat über das Zertifikatsentgelt erzielen wird, zumindest mittelbar im Interesse der Gruppe der Abgabeschuldner zu verwenden. Um die besondere Finanzierungsverantwortung der Großemittenten für Klimaschutzmaßnahmen sicherzustellen, fordert er außerdem die Implementierung eines Verbots der Überwälzung der Zertifikatskosten auf Dritte. Nawrath kommt zu dem Ergebnis, dass die Sanktionsabgabe nach § 18 Abs. 1 S. 1 TEHG die verfassungsrechtlichen Anforderungen an eine sonstige Sonderabgabe erfüllt.
