Nach einer Darstellung der europa- und verfassungsrechtlichen Rechtslage wird zum einfachen Eisenbahn-Gesetzesrecht festgestellt, dass der Infrastrukturbetrieb keine Sonderstellung gegenüber den Verkehrsunternehmen hat, sondern wie diese als privatwirtschaftliche Tätigkeit behandelt wird. Ausgehend von der Frage, ob das Verhältnis zwischen Bund und Schienennetzbetreiber dem Anwendungsbereich des Instituts der Einwirkungspflicht unterfällt, wird auf der Ebene des GG untersucht, ob die Gewährleistungspflicht des Bundes aus Art. 87e IV GG vermittelt durch das Mehrheitseigentum eine solche des Schienenwegeunternehmens ist. Sarah Wilkens kommt zu dem Ergebnis, dass sich das Schienenwegeunternehmen als Wirtschaftsunternehmen qualitativ nicht von anderen Eisenbahnen des Bundes unterscheidet, dass das verfassungsrechtlich garantierte Mehrheitseigentum dem Bund aber ermöglicht, zur Verwirklichung von Gemeinwohlzielen auf das Unternehmen zuzugreifen und die einfachrechtliche Ausgestaltung des Infrastrukturbetriebs nach Bedarf anzupassen, ohne dass sich dieses auf Grundrechtspositionen berufen kann.
