The initial motivator for the development of DRM, a Design Research Methodology, and the subsequent writing of this book was our frustration about the lack of a common terminology, benchmarked research methods, and above all, a common research methodology in design. A shared view of the goals and framework for doing design research was missing. Design is a multidisciplinary activity occurring in multiple application areas and involving multiple stakeholders. As a consequence, design research emerges in a variety of disciplines for a variety of applications with a variety of subjects. This makes it particularly difficult to review its literature, relate various pieces of work, find common ground, and validate and share results that are so essential for sustained progress in a research community. Above all, design research needs to be successful not only in an academic sense, but also in a practical sense. How could we help the community develop knowledge that is both academically and practically worthwhile? Each of us had our individual ideas of how this situation could be improved. Lucienne Blessing, while finishing her thesis that involved studying and improving the design process, developed valuable insights about the importance and relationship of empirical studies in developing and evaluating these improvements. Amaresh Chakrabarti, while finishing his thesis on developing and evaluating computational tools for improving products, had developed valuable insights about integrating and improving the processes of building and evaluating tools.

Die französisch-deutsche Grenzregion war stets eine hybride Region, die als ein Laboratorium für die Erprobung neuer Modelle diente. Napoléons cinq codes galten auch nach 1815 als Badisches oder Rheinisches Recht in mehreren Mitgliedsstaaten des Deutschen Bundes ganz oder teilweise fort, weil sich erheblicher Widerstand gegen ihre Beseitigung erhoben hatte. Zu Beginn des 20. Jahrhunderts bestand eine ganz ähnliche Situation: Nach dem deutsch-französischen Krieg 1870/71 hatte Deutschland einige ostfranzösische Departements annektiert und zum Reichland Elsaß-Lothringen gemacht. Bis 1918 wurde dort in vielen Bereichen deutsches Recht eingeführt. Dieses galt auch nach der deutschen Niederlage 1918 und dem Rückfall der Departements an Frankreich zunächst vollständig und später teilweise fort, weil sich erheblicher Wiederstand gegen die Beseitigung zahlreicher Rechtsinstitute erhoben hatte. Von diesem deutschen Zivilrecht, Gerichtsverfassungsrecht und Zivilprozeßrecht im Frankreich des 20. Jahrhunderts handelt die vorliegende Monographie.DROIT LOCAL: German Law in France at the Beginning of the 20th Century: After the Franco-German War, Germany had annexed some departments in eastern France and made them into the ›Reichland Alsace-Lorraine‹. German law was gradually introduced there. After the reversion of the departments to France, German law was initially applied in full and later in part, because considerable resistance had arisen against the elimination of numerous legal institutions. This monograph deals with this German law in 20th century France.

Das Phänomen der Due Diligence hat in den letzten Jahren eine große Verbreitung erfahren: Mittlerweile werden vor allen größeren und mittleren Unternehmenskäufen Due-Diligence-Prüfungen durchgeführt. Allerdings war lange umstritten, inwieweit sich der Siegeszug der Due Diligence mit geltendem Recht vereinbaren lässt. Fraglich war insbesondere, inwieweit Informationsweitergabe und anschließender Erwerb mit insiderrechtlichen Regelungen in Einklang gebracht werden können. Letztlich wurde diese Frage jedoch ganz überwiegend bejaht. Im Bereich des Insiderrechts wurde dieses Problem jedoch durch das Anlegerschutzverbesserungsgesetz (AnSVG) neu aufgeworfen: Gerade die Änderung des Verbotstatbestands des Wortlauts des § 14 WpHG von "unter Ausnutzung" zu "unter Verwendung" sorgte hier für erhebliche Verunsicherung. So wurde in Frage gestellt, ob die Durchführung einer Due Diligence vor Paketerwerben weiterhin möglich ist. Diese Fragestellung ist Gegenstand der vorliegenden Arbeit. Lukas Kemnitz stellt zunächst das Phänomen der Due Diligence näher dar und geht auf die zugrunde liegenden praktischen und rechtlichen Notwendigkeiten im Einzelnen ein. Anschließend werden die bisherige Rechtslage und die wirtschaftspolitischen Hintergründe des Insiderrechts erörtert. Der Hauptteil der Arbeit beschäftigt sich mit der Frage, inwieweit die Änderungen durch das AnSVG den bisherigen Ansatz tatsächlich in Frage stellen; hierzu wird zunächst ein eigenes Interpretationsmodell für nationale Vorschriften zur Umsetzung europäischer Richtlinien entwickelt, auf dessen Grundlage im letzten Schritt eine belastbare Interpretation des neuen Rechts gefunden wird. Im Ergebnis wird festgestellt, dass der bisherige Rechtszustand weitgehend unverändert fortbesteht: Due-Diligence-Prüfungen vor Unternehmenskäufen bleiben mit dem geltenden Recht vereinbar.

Widersprüchliches zwischen einem Wissen aus der Wahrnehmung und dem aus der Wissenschaft wie z. B. über die Willensfreiheit lässt sich auflösen.

In dieser Dissertation wird erstmals eine umfassende Definition des Begriffs einseitige Interpretationserklärung entwickelt und darauf aufbauend untersucht, welchen rechtlichen Regelungen solche Erklärungen unterliegen. Da das geltende Völkerrecht keine Regelungen vorsieht, ist die Definition der einseitigen Interpretationserklärung in der völkerrechtlichen Praxis und Lehre umstritten. Daher stehen Interpretationserklärungen derzeit auf der Tagesordnung der International Law Commission.Im ersten Teil wird der Begriff Interpretationserklärung in Abgrenzung zu Vertragsvorbehalten entwickelt. Der Schwerpunkt liegt auf der Abgrenzung zwischen dem Vorgang der Auslegung einer Norm und ihrer Änderung. Nachdem grundsätzlich die Unterscheidbarkeit zwischen diesen beiden Vorgängen bejaht wird, wird die Methodengerechtigkeit der Auslegung als entscheidendes Abgrenzungsmerkmal ermittelt. Daher ist eine einseitige Erklärung, die ein methodengerecht erzielbares Auslegungsergebnis enthält, grundsätzlich als Interpretationserklärung einzustufen. Dabei ist zwischen Erklärungen zu unterscheiden, die ein methodengerecht erzielbares Auslegungsergebnis vorgeschlagen (einfache Interpretationserklärungen) und solchen, die es zur Bedingung für die Vertragsbindung machen (qualifizierte Interpretationserklärungen). Letztere sind nur dann unter den Rechtsbegriff Interpretationserklärung zu subsumieren, wenn der jeweilige völkerrechtliche Vertrag kein obligatorisch zuständiges Organ für die Auslegung des Vertrags vorsieht.Im zweiten Teil behandelt die Autorin das Rechtsregime für einfache und qualifizierte Interpretationserklärungen. Erörtert werden die Voraussetzungen für ihre Zulässigkeit und Wirksamkeit, die Reaktionsmöglichkeiten der anderen Vertragsparteien, das Verhältnis zur autoritativen Auslegung und ihre Auswirkungen auf die Vertragsauslegung. Dabei wird nachgewiesen, dass einfache und qualifizierte Interpretationserklärungen die Funktion von Auslegungshilfen besitzen und denselben rechtlichen Regeln unterliegen.

This concise volume examines the characteristic electronic parameters of semiconductor interfaces, namely the barrier heights of metal-semiconductor or Schottky contacts and the valence-band discontinuities of semiconductor-semiconductor interfaces or heterostructures. Both are determined by the same concept, namely the wave-function tails of electron states overlapping a semiconductor band gap directly at the interface. These interface-induced gap states (IFIGS) result from the complex band structure of the corresponding semiconductor. The IFIGS are characterized by two parameters, namely by their branch point, at which their charge character changes from predominantly valence-band- to conduction-band-like, and secondly by the proportionality factor or slope parameter of the corresponding electric-dipole term, which varies in proportion to the difference in the electronegativities of the two solids forming the interface. This IFIGS-and-electronegativity concept consistently and quantitatively explains the experimentally observed barrier heights of Schottky contacts as well as the valence-band offsets of heterostructures. Insulators are treated as wide band-gap semiconductors.
