Ging man in den neunziger Jahren noch davon aus, mit der Neugestaltung des Nachrichtendienstrechts durch den Gesetzgeber habe sich auch der Streit um das Trennungsgebot und damit um die Frage, ob Polizei- und Verfassungsschutzbehörden kraft Verfassungsrecht getrennt sein müssen, überlebt, so hat sich in jüngerer Zeit die sicherheitspolitische Debatte, ausgelöst durch die Terroranschläge des 11. September 2001, auch insoweit wieder ebenso unerwartet wie dramatisch verschärft.Dabei ist gerade auch die Tätigkeit der Nachrichtendienste und des Bundeskriminalamtes in den Mittelpunkt des rechtspolitischen Interesses gerückt. Aufgabengebiete und Befugnisse der Sicherheitsbehörden sind wesentlich erweitert worden, sogar ihre organisatorische Zusammenfassung wird bereits diskutiert. Vor diesem Hintergrund erlangt die Frage nach der verfassungsrechtlichen Bedeutung des Trennungsgebots große Aktualität, denn erneut stehen die Grenzen zwischen nachrichtendienstlicher und polizeilicher Tätigkeit des Staates in Frage.Der Autor untersucht die historischen Ursprünge eines möglichen verfassungsrechtlichen Trennungsgebotes. Der Schwerpunkt liegt dabei auf der Darstellung der verfassungspolitischen Diskussion während der Entstehungszeit des Grundgesetzes und in der ersten Legislaturperiode des Deutschen Bundestages. Vor dem so gewonnenen verfassungshistorischen Hintergrund erfährt die Auslegung der Art. 73 und 87 GG und damit auch die Frage nach einem verfassungsrechtlichen Trennungsgebot eine überraschende Neubewertung.
