Am 12. Januar 2008 feierte Prof. Dr. Dr. h.c. Peter Lerche, emeritierter Ordinarius für Öffentliches Recht an der Universität München, seinen 80. Geburtstag. Aus diesem Anlass veranstalteten seine habilitierten Schüler ein Kolloquium in der Carl Friedrich von Siemens Stiftung München. Der Band dokumentiert die dort gehaltenen Vorträge. Unter dem Titel "Realitätsprägung durch Verfassungsrecht" wird jeweils an das Werk Lerches angeknüpft. Gemeinsamer Grundgedanke der hier versammelten Abhandlungen ist die von Peter Lerche immer wieder bekräftigte Einsicht, dass die dirigierende Kraft der Verfassung auch über die Verfassungsrechtsprechung hinaus und jenseits von ihr wirkt. "Verfassungsvollzug" erschöpft sich nicht in Verfassungsjudikatur.Diesem Thema gehen die Autoren anhand unterschiedlicher Sachfragen und Rezeptionsvorgänge nach. Rupert Scholz behandelt das Problem der verfassungsrechtlichen Vor-Prägung politischer Themen mit den Gefahren einer Lähmung des politischen Lebens durch übertriebene Verrechtlichung; die Anpassung von Verfassungstexten sowie geglückte, missglückte und unterbliebene Verfassungsänderungen sind das Thema von Christian Pestalozza. Dieter Lorenz untersucht aktuelle sicherheitsrechtliche und grundrechtliche Fragen (insbesondere der Online-Durchsuchung); Michael Kloepfer behandelt die Rückwirkungen von Verfassungsverstößen auf die öffentliche Meinung und die dadurch ausgelösten (oder unterbliebenen) politischen Sanktionen. Hans D. Jarass wendet sich dem Problem der Konstitutionalisierung der Rechtsordnung durch die Grundrechte zu; Christoph Degenhart untersucht die Rückwirkung realer Veränderungen auf die Verfassungsinterpretation. Oliver Lepsius analysiert, wie das Bundesverfassungsgericht seine Entscheidungen aufbautechnisch begründet, um sachverhaltsübergreifende verfassungsrechtliche Maßstäbe bilden zu können.
