Christian Lindenschmidt zeigt, dass dem Strafrecht im Bereich der strukturellen Ämterpatronage eine klassische ultima ratio Funktion zukommt. Darüber hinaus unterbreitet er einen Formulierungsvorschlag für einen Sonderstraftatbestand zur Verfolgung der strukturellen Ämterpatronage, der nach der nachgewiesenen Nähe von struktureller Ämterpatronage und Korruption systematisch im Strafgesetzbuch bei den §§ 331 bis 335 StGB angesiedelt werden sollte.

Von der Daseinsvorsorge kann dies bis in Sozialversicherung und Besteuerung ausgedehnt werden. Auch staatliche Kontrollen sollten sich immer mehr den Rechtsformen privaten Wirtschaftens annähern.Aus dem herkömmlichen Bereich des hoheitlichen Öffentlichen Rechts öffnen sich zunehmend Wege zum Privatrecht, auf denen öffentliche Interessen verfolgt werden wie private Belange, zusammen mit diesen: Die große Welle der Privatisierungen kommt aus der Überzeugung von der höheren Effizienz privater Gestaltungen.Eine weitestgehende Privatisierung des Öffentlichen Rechts, welche dieses allenfalls auf letzte Rechtsdurchsetzung beschränkt, hebt die - notwendige - Staatlichkeit nicht auf; es erscheint aber die Vision eines "privaten Staates", der Freiheit in Gleichordnung sichert.
